The user understands that any infringement of copyrights may be pursued vigorously and the user agrees to pay additional charges levied for copyright infringements, court settlements and court judgments. In the event of an infringement, the user further agrees to pay attorney's fees incurred by Stock Asylum, LLC, and the photographers participating on this web site.
2) The user may open images for viewing within the users web browser only for the purpose of evaluating the images for potential license or for evaluating the participating photographers. The user may not copy, print, alter, transmit, or save (or make any use whatsoever of) the images on The Stock Asylum, LLC, web site in any media, electronic, print or otherwise, without permission from the copyright holder.
3) In using this web site the user waives any so-called "fair use" rights and agrees to make no use of any image presented on the web site without permission from the photographer or the photographer's agent. The user agrees to pay fees for so-called 'fair uses" deemed reasonable by the photographer or the photographer's agent. The user agrees that he/she/it will NOT place any image found on this web site into any collection, data base or search engine.
4) The Stock Asylum, LLC, is not an agency and does not represent any of the photographers whose images appear on this web site. The user understands that any agreements between the user andany photographer displaying images on this web site (or any agent for any photographer displaying images on this web site) do not involve The Stock Asylum, LLC, its owners, officers, or employees. When licensing any image displayed on this web site, the user shall obtain copies of all pertinent model and property releases from photographer and/or the photographer's agent and make certain that all uses comply with specific releases involved. Furthermore, it is the user's absolute responsibility to make sure that the photographer (or the photographer's agent) has all necessary legal rights to license the image and that the image does not infringe on any third party rights, including, but not limited to, trademarks. The user warrants that he or she will be diligent in making sure that any and all usages he or she makes of images found on this web site comply with the terms of the appropriate model releases and property releases. Furthermore, the user agrees to make only proper and legal uses of any images displayed on Stock Asylum and will hold both Stock Asylum, LLC, and its participating photographer harmless should any legal action result from the improper usage of any image displayed on the Stock Asylum web site.
